These Terms of Service ("Terms") govern your access to and use of TunePulse (the "Service"), operated by TunePulse ("we", "us", "our"). By creating an account, uploading data, or using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.
TunePulse is a web-based platform that accepts uploaded ECU (Engine Control Unit) datalog files, parses them, generates interactive charts and reports, and provides AI-generated analytical insights about vehicle tuning parameters. Users may store logs by vehicle, share reports via tokenized links, and invite collaborators by email.
You must be at least 18 years of age to use the Service. By registering, you represent that you are at least 18 and that the information you provide is accurate and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly via our contact page if you suspect unauthorized access.
We reserve the right to approve, suspend, or terminate accounts at our discretion, including accounts that are inactive, violate these Terms, or pose a risk to other users or the Service.
The Service provides informational analysis of ECU and vehicle log files only. It does not provide mechanical, engineering, calibration, emissions, legal, racing, or road-use advice, and it is not a substitute for a qualified tuner, mechanic, engineer, or other professional.
Any thresholds, alerts, health indicators, parameter comparisons, or AI-generated insights displayed by the Service are informational outputs derived from uploaded data. They may be incomplete, incorrect, based on assumptions, or inapplicable to your specific vehicle, modifications, environment, or use case.
You must not rely on any Service output as a basis for decisions about vehicle safety, driveability, emissions compliance, racing suitability, or mechanical repair without independent verification by a qualified professional. Doing so is entirely at your own risk.
The Service may produce AI-generated analyses, hypotheses, summaries, or recommendations about uploaded data. These outputs are probabilistic assessments that may be incomplete, incorrect, or based on assumptions that do not apply to your vehicle or situation. Hypotheses should be treated as hypotheses unless verified by competent human review and real-world inspection.
We do not guarantee the accuracy, completeness, or fitness of any AI-generated output for any purpose.
ECU tuning may affect emissions output and compliance with federal, state, and local regulations. The Service does not verify, certify, or guarantee that any tuning configuration, parameter set, or calibration analyzed by the Service is lawful for use on public roads in any jurisdiction.
It is your sole responsibility to ensure that your vehicle and its tuning configuration comply with all applicable emissions standards, vehicle safety regulations, and road-use laws. Products and tuning configurations analyzed through the Service may be intended for off-road, competition, or track use only. We make no representation about the legality of any tuning setup in any jurisdiction.
You agree to use the Service only for lawful purposes and in compliance with all applicable laws. You represent and warrant that:
You retain ownership of all data you upload to the Service, including raw log files, vehicle records, labels, notes, and mark events ("User Content").
By uploading User Content, you grant us a limited, non-exclusive, royalty-free license to store, process, parse, analyze, render, display, and transmit your User Content solely for the purposes of operating and providing the Service to you. This license includes generating charts, reports, derived metrics, AI insights, and shared views as directed by you.
This license terminates when you delete your User Content or your account, subject to our backup and retention practices described in our Privacy Policy.
If you create a share link, any person who obtains that link may be able to view the shared log report, including charts, notes, labels, marks, confidence levels, and other information included in that shared view, until the link expires or is revoked.
You are responsible for managing your share links, including revoking access when appropriate. We are not responsible for any consequences of sharing reports, including exposure of vehicle data, tuning parameters, or notes to unintended recipients.
If you invite a collaborator by email, the invited person will receive access to the logs and data you have selected. Collaborators with re-share permissions may create additional share links within the scope of their access.
The Service, including its design, code, features, branding, and documentation, is owned by TunePulse and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without written permission.
We respect intellectual property rights. If you believe that content on the Service infringes your copyright, you may submit a notification under the Digital Millennium Copyright Act (DMCA) via our contact page.
Your notice must include: identification of the copyrighted work, identification of the infringing material with enough detail to locate it, your contact information, a statement of good-faith belief that the use is not authorized, a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner, and your physical or electronic signature.
We may remove or disable access to allegedly infringing content and may terminate the accounts of repeat infringers.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure; that any data, analysis, insight, chart, or report produced by the Service will be accurate, complete, or reliable; or that defects will be corrected. Your use of the Service and reliance on any output is at your sole risk.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TUNEPULSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, ANY CONTENT OR OUTPUT PROVIDED THROUGH THE SERVICE, OR ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless TunePulse, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) any third party's use of content you shared or made accessible through the Service.
You may not use the Service in violation of U.S. export control laws and regulations, including the Export Administration Regulations (EAR), or economic sanctions programs administered by the Office of Foreign Assets Control (OFAC). You represent that you are not located in, under the control of, or a national or resident of any country subject to comprehensive U.S. sanctions, and that you are not a prohibited or restricted party under applicable export or sanctions laws.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may delete your account at any time through the Service or by contacting us.
Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination shall survive, including but not limited to Sections 7, 8, 11, 12, 13, 14, and 17.
We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the Service with a new effective date. Your continued use of the Service after any change constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising under or relating to these Terms shall be resolved exclusively in the federal or state courts located in Texas, and you consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and TunePulse regarding the Service.
